Quick answer

An Air Serbia disruption can support a claim, but where the journey began matters. An EU departure can be covered by EU261 even on Air Serbia. A standalone Belgrade departure does not become an EU flight simply because it lands in the EU. Check Serbian or other applicable rules separately, particularly for delay-only compensation.

Can You Claim Compensation from Air Serbia?

Read the operating-airline line on your confirmation, not only the company that sold the ticket. Keep the full itinerary and identify whether your problem was a long arrival delay, cancellation, involuntary boarding refusal or missing care. These are different requests with different evidence.

The CAA route matrix sets out the UK distinction. Use our EU passenger-rights guide, UK261 guide and ECAA and Balkan guide for the relevant framework. EEA and Swiss journeys need their own scope check.

Serbian delay claims need care

The Serbian Civil Aviation Directorate's guidance distinguishes national delay provisions from the EU court's three-hour compensation approach, while also referring carriers to that case law. Do not present a Serbian-law-only delay claim as an automatic EU261 payment. Ask the airline to identify the legal basis it applied; obtain qualified advice for a disputed interpretation.

How Much Compensation Can You Claim?

For a qualifying EU-covered arrival delay, the starting bands are below. This is not a universal tariff for every Air Serbia flight.

Covered journeyArrival delayPer passenger
Up to 1,500 kmAt least 3 hours€250
Intra-EU over 1,500 km; other journeys over 1,500 km up to 3,500 kmAt least 3 hours€400
Other journeys over 3,500 kmAt least 3 but less than 4 hours€300
Other journeys over 3,500 kmAt least 4 hours€600

Coverage and any valid extraordinary-circumstances defence still matter. Cancellation and denied-boarding reductions follow their own replacement-arrival tests. See Your Europe and the delay guide. For UK claims, use UK amounts, not a euro conversion.

Delay, Cancellation, and Denied Boarding Rules for Air Serbia

ProblemEvidence to establishRequest to assess
Long delayOriginal itinerary, arrival time and applicable law.EU delay compensation where covered; care and abandoned-journey refund separately.
CancellationNotice received, proposed alternative times and cause.Refund/rerouting, care and possible compensation. Short notice alone is not enough.
Boarding refusalTimely presentation, documents, reason and any volunteer agreement.Involuntary refusal differs from voluntarily accepting a later flight.
Meals or overnight stayAssistance requested/offered and necessary costs.Care expenses, not a second fixed-compensation claim.

Air Serbia's passenger-rights notice describes cancellation and boarding-refusal compensation, distance-based care thresholds and refund rights after a departure delay of at least five hours. Check its scope before relying on a particular remedy.

Choose before cancelling your own ticket

Airline cancellation and your voluntary decision not to travel are different. Ask what refund or replacement is available and keep the offer before making a choice. Do not assume you can take both the original ticket refund and replacement travel for the same unused transport.

For covered EU cases, Articles 5, 6, 8 and 9 of Regulation 261 distinguish notice exceptions, refund/rerouting and care. A compensation defence does not automatically remove assistance. Follow the focused cancellation and denied-boarding guides.

How to Assess an Air Serbia Rejection

Read what the airline actually decided. A rejected compensation request may leave an unanswered care request; a route objection may concern only one part of your booking.

Ask the airline to explain

  • The applicable law and route it assessed.
  • The event that affected your flight and its timing.
  • The replacement-arrival calculation behind a reduction.
  • Whether it separately assessed your expense request.

Check your file first

  • Correct operating airline and travel date.
  • Original and replacement itineraries.
  • Proof of arrival, notice or gate presentation.
  • Any requested authority documents already supplied.

A generic operational label deserves clarification, but is not proof that compensation is owed. External restrictions can affect a flight even when another service operates. Keep the airline's account beside your dated evidence rather than relying on social-media reports about a different flight.

Air Serbia Response Times and Complaint Deadlines

Use the deadline for the procedure you are following. The Serbian Directorate's published framework specifies an airline complaint within 90 days of the operated or scheduled flight, and a 60-day response period after all necessary documents are supplied. These are procedural periods, not measured payout averages or a universal EU court deadline.

For an older flight, do not assume that missing one complaint period necessarily answers every possible legal remedy. Obtain advice on the applicable jurisdiction and limitation period. Our claim-stage guide helps distinguish acknowledgment, decision, escalation and money received.

The claims page currently accepts requests for Air Serbia-operated flights in Serbian or English and gives a 20-minute form window. Prepare the text and attachments beforehand. Choose the relevant disruption category, identify everyone you represent, follow its authority-document requirements and retain the confirmation. Portal instructions may change.

Keep the request easy to assess

Use a short chronology: booked journey; what changed; when you were informed or arrived; assistance requested; remedy sought; attachments. List fixed compensation, ticket refund and documented expenses separately. Do not include passport or bank information in public comments.

Claim Directly or Use a Claims Partner?

You can file directly without paying a claims-service commission. A partner may assist with supported disputes, but check fees, mandate terms and which remedies it handles before sharing documents. A partner does not make an otherwise ineligible flight eligible.

Required Documents for an Air Serbia Claim

  • Confirmation, e-ticket and complete booking, including all connections.
  • Operating flight number, travel date and boarding or check-in evidence.
  • Original and replacement schedules, notice messages and arrival evidence.
  • The reason given for disruption or refusal, preferably in writing.
  • Requests for help, what was offered and itemised necessary-expense receipts.
  • Claim reference, correspondence and authority to represent another passenger where required.

Keep originals privately. Name attachment copies by date and subject so the claim handler can follow the sequence. A missing boarding pass is a reason to assemble other proof, not to invent a document.

Belgrade Connections and the Balkan Route Check

Illustration, not a reported claim: on an EU-origin journey booked through to a final destination via Belgrade, preserve both legs when explaining a missed connection. On two independent bookings, the first ticket does not automatically protect the second. Simply buying both through the same website does not establish a single protected reservation.

Follow the complete booking

A delay at Belgrade does not erase the original departure of a through journey. Equally, landing in an EU country does not turn a standalone Air Serbia flight from Serbia into EU-carrier inbound coverage. Establish the booking before choosing the rule.

Continue with connections and separate tickets, Belgrade Airport, Nis Airport or national Balkan coverage. These are guidance links, not a current route timetable.

What to Do If Air Serbia Rejects or Does Not Answer

For a Serbian-procedure complaint, the Directorate's passenger complaint instructions explain the airline-first route and reporting after the complete-file response period. Air Serbia's notice also directs unresolved or unsatisfactory responses to the Directorate. Include the original request, receipt and reply; ask which issues the authority can address.

For an EU-origin dispute, check the competent national enforcement body and any applicable ADR or court route. A regulatory report is not automatically an individual payment order. Do not assume ordinary airline correspondence stops a court deadline.

Frequently Asked Questions

Can I claim compensation from Air Serbia for a 3-hour delay?

A qualifying EU-covered journey may support compensation after at least three hours at final arrival, subject to the cause and other conditions. Do not automatically apply that result to a Serbian-law-only departure; national delay guidance needs a separate assessment.

Does a Belgrade-to-EU Air Serbia flight qualify under EU261?

Not solely because it arrives in the EU. Air Serbia is a non-EU carrier. A standalone Serbian departure needs a national-law check; a through booking that originally departed the EU can require a different analysis.

Where should I submit an Air Serbia claim?

Start with the official Air Serbia claims page for a flight it operated. Prepare the itinerary, disruption evidence and any authority documents before opening the form, then save the case reference and submission copy.

How long should I wait before contacting the Serbian authority?

The published Serbian procedure specifies a 60-day response period after the airline has all necessary documents. Check the authority's current instructions and jurisdiction. This is not a promised payout date, and the initial airline complaint has its own deadline.

Can I request meals or hotel costs if compensation is refused?

Possibly. Care is a separate question under the applicable rules. Explain what assistance was requested and missing, and supply itemised reasonable costs. A receipt or a compensation rejection alone does not settle reimbursement.
